Follow all of your local, provincial/state, national and international laws and regulations. Be responsible for all information, data, text, photographs, images, graphics, messages or other material (“Content”) that occur under your account or password, including any Content transmitted or broadcast through your account.

Comply with all applicable laws regarding the transmission of technical or other data exported from the country in which you reside.

You also agree that you will not:
Upload, post or transmit through your TipTopWebSite.com site any unlawful, harassing (including “stalking”), hate speech, defamatory content pornographic, abusive, threatening, harmful, obscene, libelous, tortuous, defamatory, vulgar, invasive of another’s privacy, hateful, excessively violent or racially, ethnically or otherwise objectionable content, Is illegal, or promotes or encourages illegal activity, promotes, encourages or engages in terrorism, violence against people, animals, or property; Promotes, encourages or engages in any spam or other unsolicited bulk email, or computer or network hacking or cracking; Violates the Ryan Haight Online Pharmacy Consumer Protection Act of 2008 or similar legislation, or promotes, encourages or engages in the sale or distribution of prescription medication without a valid prescription; Infringes on the intellectual property rights of another User or any other person or entity;Pornographic material includes genitalia displayed as well as sexual acts. Exceptions can be made with our prior consent. For example, we may consent to a site that teaches how to breast feed. If you feel that your site may be an exception, please send us an e-mail stating your case at to have your site through either the email support feature in your website (log in at "TipTopWebSite.com", go to "contact us "). We have final say on this matter.

Copy, broadcast, distribute, or otherwise use any content provided by others, in a manner that is unlawful, harassing, abusive, threatening, harmful, obscene, libelous, tortuous, or otherwise objectionable on your TipTopWebSite.com site. This includes trolling and posting any type of documents that reflect negatively towards another person.

Sell any type of deceiving data entry jobs or any type of fraudulent relief site.

Host or transmit any content that might infringe the intellectual property rights, privacy rights, rights of publicity, or other proprietary rights of others.

Copy, broadcast, distribute, or otherwise use any content provided by others, in a manner that infringes the intellectual property rights, privacy rights, rights of publicity, or other proprietary rights of others.

Interfere with or disrupt TipTopWebSite.com's site, services, computer systems, servers or networks, or violate the regulations or policies of such networks.

Transmit any content containing viruses, trojan horses, worms, time bombs, cancelbots, or any other harmful programs.

Attempt to gain unauthorized access to TipTopWebSite.com's site or services, others' accounts, private web sites, or computer systems or networks connected to TipTopWebSite.com's site, through password mining or otherwise.

Engage in any systematic extraction of data or data fields, including without limitation e-mail addresses.

Attempt to defeat, modify or bypass any pages or functionality of the site.

Collect information about others without their consent.

Provide false information on your registration form, impersonate any person or the voice of any person, or otherwise attempt to mislead others about your identity or affiliation with a person or entity or the origin of a message or other communication.

Transmit junk mail, spam, chain letters, or other unsolicited bulk e-mail or duplicative messages containing your website address or domain name.

Copy audio content without the permission of all parties to the conversation.

Sell access to or use of any services available on TipTopWebSite.com's site.

Interfere with anyone's use or enjoyment of TipTopWebSite.com's site.

Harm minors in any way.

Fail to respond to customer, copyright or trademark holders questions within 12 hours. If you fail to respond, we will remove the copyright or trademark item(s) from your website. We will delete your website if there was a prior copyright or trademark complaint on your account. You will not be able to sign up again if you violate this.

Promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, but is not limited to, providing instructions on how to assemble bombs, grenades and other weapons and creating “Crush” sites.

We have the right to cancel and delete any website at anytime that violates any part of our terms or that receive complaints or we feel is a deceptive website. If you send email spam and have more than one account with us, all your accounts will be deleted. You will not be allowed to sign up again if this happens. Free websites will be removed on or before December 2008 if not upgraded to a paid version. Your website will be cancelled if your credit card is declined for more than 20 consecutive days or will be tried again after that time and will be continued to be tried until the past due payment amount is processed or you request to cancel via email. If over 6 months past due, we will attempt to charge ninety nine dollars for a 2 year special for package 2 or one hundred nineteen dollars forty cents for package 3, this is a great savings for you. If the card is declined at that point, your website will be removed. .If you do request to cancel, you must email us stating you want to cancel and include your username and password on your account in that email. You can update your credit card at anytime in the members section under the "update billing info" link.

You can cancel your website at anytime.
To cancel, login the members section, click "contact us" and simply request to cancel. We will cancel your account and future billing. New domains that are registered through us cannot be transferred away from us in the first 60 days. Domains from promo codes are only at no charge if you remain an active paying member or ours and the domain from the promo code is on that account being an active paying member. There are no refunds for any charges that were made prior to your cancelling, but no future charges will take place.

We do not offer refunds of any kind. This includes, but is not limited to any package, upgrades, domains, domain renewals or yearly promotions.
We are not liable for any bank fees your bank charges you.

We reserve the right to immediately delete any website that you build that contain copyrighted images or infringe on another company's trademark or company's business or violate any part of our terms. We will post a message on your website to login to your account to update your account if your billing has been declined or if you have asked us not to use a credit card on file and have not updated your account with a new one. We reserve the right to modify our templates at anytime. Our © and message must remain on each page. We reserve the right to change these terms at anytime. We reserve the right not to support any member at anytime if we feel they are being out of line with our support staff.

Domains ordered through us renew yearly at $25/year as long as your account is active with us. We will attempt to renew the domain in time. If we do not, you can email us to remind us if you notice it has not been renewed. We will attempt to renew it at that time if we did not already do so. We make no guarantee that we renew every domain when it is up for renewal. Websites will renew every month or year or two or three years, depending on your plan at renewal. Any promo code used for a domain will apply to one domain per account only. Promo codes do not apply for free sites. If you use a promo code to get a free domain or receive a free domain from us and want to transfer your domain to another host, there is a $25 domain release fee. Free domains are for the first year of the domain and the domain set up. There is a $25/year renewal fee for all domains. There is no charge to release a domain if you paid for the domain. We can only release the domain to the person that signed up for the account. We will do our best to renew each domain, please email us if you do not see your domain active at anytime. It is your responsibility to make sure your domain remains active. Package 1 is billed yearly at $23.40/year. We do not downgrade packages once you select to upgrade.

Your website will be easy to build within the first 3 days of your trial. If you find it is not easy, or want to cancel for any reason, you can email us (under the "contact us" link in the member section) or call us to cancel within the first 3 days of signing up and you will not be billed.

IN NO EVENT SHALL TipTopWebSite.com AND/OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF USE, DATA OR PROFITS (HOWEVER ARISING, INCLUDING NEGLIGENCE) EVEN IF TipTopWebSite.com OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES, ARISING OUT OF OR IN CONNECTION WITH (A) THE USE OR INABILITY TO USE THE SERVICE, (B) THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, (C) FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SERVICE OR OTHERWISE ARISING OUT OF THE USE OF THE SERVICE, (D) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE, OR (E) ANY OTHER MATTER RELATING TO THE SERVICE. SOME STATES DO NOT ALLOW THE LIMITATION OF LIABILITY, SO THE FOREGOING LIMITATION MAY NOT APPLY TO YOU. IN NO EVENT SHALL TipTopWebSite.com's AGGREGATE LIABILITY TO YOU AND/OR ANY THIRD PARTY ARISING FROM OR RELATING TO THIS AGREEMENT EXCEED THE AMOUNT YOU ACTUALLY PAY TO TipTopWebSite.com. Without limiting the foregoing, neither TipTopWebSite.com nor its suppliers is responsible for any of your data residing on the Service or TipTopWebSite.com's suppliers' hardware. You are responsible for backing-up your data and information that may reside on the Service or TipTopWebSite.com's suppliers' hardware, whether or not such information is produced through the use of the Service. It is your responsibility to take the necessary steps to ensure that your primary means of business is maintained (if applicable).
